Zhang Yesui: Strengthening personal information protection through legislation becomes an inevitable requirement
Zhang Yesui, a spokesman for the Second Session of the 13th National People's Congress, said in response to reporters' questions that strengthening personal information protection through legislation has become an inevitable requirement to protect the privacy of citizens, the safety of life and property, and regulate the healthy and orderly development of the Internet.
Zhang Yesui pointed out that, in fact, China already has a number of laws, regulations and rules concerning the protection of personal information. For example, criminal law, general rules of civil law, consumer rights protection law, network security law, e-commerce law, etc., have made relevant provisions.
Zhang Yesui said that the protection of personal information needs to be formulated in accordance with the development of specific laws to regulate and form a joint force. The Standing Committee of the National People's Congress has included the formulation of the Personal Information Protection Law in the current legislative plan, and relevant departments are intensively studying and drafting it for early release.
Peng Jing: Regulate the collection of personal data and protect the security of personal information
Peng Jing, member of the National Committee of the Chinese People's Political Consultative Conference and director of Chongqing Jingsheng Law Firm, stated in the proposal that it is recommended to standardize the collection of personal data on the mobile Internet and protect the security of personal information.
Nowadays, the widespread application of the App has brought great convenience to people, but at the same time, it is also fraught with risks. Theft of user privacy, false publicity, malicious deductions, and deception fraud are common occurrences, which bring great hidden dangers to network security, and also seriously affects Adolescents' physical and mental health. In this regard, Peng Jing pointed out that it is necessary to strengthen the classification and supervision of App, and actively promote the improvement of related legal systems such as the regulation of minors' network protection.
Peng Jing suggested in the proposal that a special "Personal Information and Data Protection Law" be introduced as soon as possible to define the scope of protection of personal data and information. First of all, it should be clear which information belongs to basic personal information, and which information belongs to personal sensitive information and special information that should be protected by law; second, special protection or even unconditional protection of personal information of special groups such as children and disabled persons; finally, public figures The scope of protection of personal information is moderately “restricted”, and the personal information of “mining” public figures such as the media and the Internet should be tolerated, but the legal bottom line is that they must not be fabricated or fabricated out of thin air.
In addition, Peng Jing also suggested that the legal liability for illegally collecting and obtaining personal information through the mobile Internet should be clearly specified. First, the intensity of criminal responsibility can be appropriately increased. Secondly, the data subject should be given the convenience of civil liability for parties involved in illegal collection and improperly obtaining personal information, and reasonable compensation should be granted. Consumer organizations, procuratorates and other authorized institutions should be allowed to initiate public interest lawsuits against the subjects who collected personal information illegally to realize consumption And network users' "zero cost" rights protection. At the same time, the administrative responsibility of the illegal subject shall be investigated.
Hongyi Zhou: Security should be the foundation and prerequisite for the development of artificial intelligence
Member of the National Committee of the Chinese People's Political Consultative Conference, Chairman and CEO of 360 Group, Zhou Hongxuan announced his three "two sessions" proposals this year, involving national security cyber security brain building, smart car cyber security, artificial intelligence security risks and other security hot topics.
In the proposal to build a national-level cybersecurity brain, Zhou Hongyi stated that the national-level cybersecurity brain is listed as a major national project. It is recommended to establish a national cyber security brain project overall working group, expert group, and engineering promotion group, which are responsible for the top-level design and overall planning, system design, and engineering construction, respectively. Use the new nationwide system to accelerate the construction of a national cybersecurity brain. Led by relevant national departments, coordinate the departments and units such as internet information, industry information, public security, science and technology, and organize the wide participation of state-owned enterprises, private enterprises, scientific research institutes, etc.
In the proposal of smart car network security, Zhou Hongyi gave three suggestions. Formulate compulsory production standards and list network security as a standard for smart cars. The first is to install a secure networking module to improve networking protection capabilities, establish a secure interface, and strengthen the control security protection of automobiles to prevent control hijacking. The second is mandatory safety testing. Establish a test and evaluation system, and conduct network security evaluations before the car goes on the market. The third is to establish a vendor security operation platform, improve security operation capabilities, and detect and block hacking attacks in a timely manner.
In the proposal of artificial intelligence security risks, Zhou Hongyi suggested that security should become the basis and prerequisite for the development of artificial intelligence. However, the problem of artificial intelligence network security is very complicated, and it is urgent to establish an open innovation platform, integrate various resources, and promote and solve them in a coordinated manner. The state attaches great importance to the construction of a new generation of artificial intelligence open innovation platform. Construction of artificial intelligence open innovation platforms has been approved in the five areas of autonomous driving, urban brain, medical imaging, intelligent voice, and intelligent vision, but it is still blank in the field of artificial intelligence network security. It is suggested that the state support the establishment of a national cybersecurity artificial intelligence open innovation platform as soon as possible to ensure the healthy and orderly development of artificial intelligence.
